PLDT loses dispute over 'pldt.com' domain name

THE FIRST and longest domain and trade name dispute in the Philippines between the country's biggest telecommunications company and Gerry Kaimo, registered owner of the "pldt.com" domain name, ended Tuesday as the courts decided in favor of Kaimo.

In a court order, Judge Reynaldo Daway denied the request for a preliminary
injunction by the Philippine Long Distance Telephone Co. (PLDT) against Kaimo, who in turn was accused of allegedly infringing on the telephone company's
Trade name, and for "engaging in unfair competition for using the trade name."

"After carefully considering and evaluating evidences presented during the
hearing and after duly considering the documents adverted to and relevant
pleadings including their respective memorandum in so far as they are pertinent to the issue under consideration, the Court finds that the plaintiff (PLDT) has not been able to show its entitlement to the relief prayed for," the court
ruling stated.

The ruling, dated January 29, 2004, was issued from Branch 90 of the Quezon
City Regional Trial Court.

Kaimo is the registered owner of the domain name "pldt.com," on which he
recently placed a website for political commentary on the current
administration.

Four years ago, PLDT filed a 1.35-million-peso lawsuit against Kaimo, arguing
that he was violating the company's intellectual property over the PLDT trade
name.

In its complaint, PLDT claimed that Kaimo and advocacy group Philippine League for Democratic Telecommunications Inc. (PLDTi) have violated the company's intellectual property right for using the trade name which it has been using for more than 70 years.

Reacting to the court ruling, Kaimo said: "Today, I'm very happy. We have
shown that we have the capacity to fight this giant."

In a telephone interview with INQ7.net, Kaimo said that his victory shows that the "little guys" have a chance against the "giants."

"It's a battle won for now at least. I don't think the war is over though.
Their resources are deep," Kaimo added, expecting that PLDT would appeal the
case to higher courts.

The court has set a pre-trial conference on February 23, 2004 for Kaimo's
50-million-peso countersuit against PLDT.

Meanwhile, officials from the PLDT declined to comment on the ruling, saying
that they have to wait for official word from its lawyers at Sycip Salazar.

The situation today is just too bizaare for me to comment on. Masayadong makapal na ang mukha ng Pangulo. Pangulo na lang ba siya ng mga ibang pulitiko sa pagloloko sa mga Pilipino upang mga sariling ambisyon nila ay matuntungan. Paano na ang bayan? Iwan na lang kay Jose Pidal? Ang grupo naman ng mga artista ay ginagamit ang mga masa sa pananakot na magakakarebolusyon kung sakali matalo sila. Eh sakali talagang matalo sila? Paano ngayon ang Pilipinas? Sila nalang palagi nalang ba ang masussunod? Mula pa sa panahon ni Marcos ganoon na. Hanggan ngayon ganoon pa rin. Talagang hindi natututo ang Pinoy. Kaya nga sinabi ko sa www.pldt.com na may US passport sa FPJ. Para kung sakali manalo siya, aalis na rin siya patungo sa America katulad ng 19% ng atin kababayan.

As the line in pldt.com says. You lie down with dogs, you get up with STD. A very wise person told me that today. A person who observes people for a living, one who has to be quite astute to stay ahead of the rest in her profession. Those who choose to fool the majority will one day pay the dire consequences for their actions. Those in power who find it better to keep the Filipino ignorant, just as the Spanish friars did. Those who think it better for themselves to keep the average Pinoy in the dark about the little things as well as the big things won't have their way forever. Things have a way of coming back to you. Karma it is called. The law of action and equal and opposite reaction. We are watching now as the COMELEC tried to pull a fast one over every voter via their automated voting process. Kudos to the brave Gus Lagman who tried to call everyone's attention to the problem way before the issue blew up in Abalos' face. Maybe they need the machines to cheat, so they gave it to a company who will ensure that they will emerge winners maybe in exchange for bagging the lucrative contract plus who knows what else? Maybe that's why Gloria wanted Davide out of the way to begin with. Because she knew the case would eventually wind up in the Supreme Court's hands. Exactly where she doesn't want Davide. All the deals she is getting into are going to get her into trouble because of blind ambition. Ambition that is driving her to hold on ever so desperately to that seat of power. Yet it has become obvious that the people don't want her. All the surveys show that. But power is a quite the drug, and those who have tasted it want more, and nothing but more. So it looks like damn the torpedoes for Gloria. So she made pacts with the devil. Or devils in her case. Unfortunately her Pandora's box is slowly opening and the evil lurking within is slipping out. Let's watch and see what happens. It won't be long now.

There is actually no need to be too confused about the political moves of GMA. If one remembers that before EDSA 2, she was in ERAP's cabinet, then one can understand why it is getting clearer to all why it is apparent that ERAP is calling the shots around here. She is still a part of his cabinet. And it now makes perfect sense. The moves to send him to the USA, the so-called reconciliation efforts (reconciliation without justice, that is), and the other sleight-of-hand tricks we have been seeing before our very eyes. It's all part of their grand scheme. So, as they say, "obvious ba"? Suckers we were for hundreds of years, suckers we will be for years to come.

What a crazy country. What can she be thinking? She probably has her eyes (tunnel vision) trained on the presidency. What other reason could she have to join the Marcos ERAP forces that she pretended to be so much against? Talk about opportunism! Her only problem is that she won't win against Noli de Castro, who is a shoo-in for the Veep slot in the 2004 run. And that leaves her nowhere after the elections. She is a particularly interesting study because of all the balimbings she stands out the most, even more than Biazon, another trapo. Heck. They are all TRAPOS. Only she figured out in her own small little mind that in hooking up with "Da King", she might just be able to squeeze in as "Da Queen". Or so she thinks. Big mistake. And then there's the connection she must pretend to severe-that with the Meralco and ABS-CBN owners and her patrons, the Lopezes. I wonder if they will just play pretend on that one or whether the Lopezes will eventually get pikon and junk her. Chances are that they will play both their candidates, Noli de Castro and Loren and support them both in order to have a foot in the door come May. Boy don't you just just love this playing political analyst stuff? On a blog page at that! In the meantime, while these egomaniacs wreak havoc on the political and economic systems of the Philippines, the number of poor people starving continue to grow. Oh when we will we ever learn? When we we ever learn?
GMA? Oh, don't expect us to stoop that low and discuss that matter here in this most venerable of blogspots.

The country has gone to the dogs. Watch for the re-emergence of the term "tuta" as it seems everyone is everyone's "tuta" , or puppy, in one way or another. Look at the bright side. It's only January 6, 2004. The worst is yet to come. Thanks loads to the national leadership, which has led us all to the dustbin. And they want another 6 years? Exactly how much more pillaging can this country take anyway? Something's gotta give.
